How your subscription works.

These Terms govern Radar Nocturno's relationship with venues that take out a B2B subscription. If you are a person using the app, the Terms for users apply to you instead.

L1 · Identification of the provider

In compliance with art. 10 LSSI-CE (Spain's information-society services act):

L2 · Purpose

These Terms govern access to and use of Radar Nocturno (“the App”) by Venues that take out a B2B subscription. The Venue accesses specific features (occupancy status reporting, featured listing, events, badge and prominence on the map) depending on the current plan.

L3 · Access and eligibility

L3.1 · Ownership and standing

A Venue may only be signed up by:

  • The owner of the establishment, a natural or legal person with the legal capacity and sufficient authority to contract on the venue's behalf; or
  • An authorized representative of the owner, expressly designated to manage the venue's digital presence on external platforms and with sufficient authority to bind the owner.

By subscribing, the person declares, on their own responsibility, that they meet one of the above conditions and hold the necessary standing.

L3.2 · Minimum age of the individual operator

The individual acting on behalf of the Venue must be 18 or over. Internal access to the /panel dashboard requires a personal account subject to the same minimum-age requirements set out for Users.

L3.3 · Nature of the venue

The Venue declares that it is legally authorized to operate in its jurisdiction and to comply with the sector rules that apply to it (activity licence, health, labour and tax regulations, and data protection with respect to its own clientele). Radar Nocturno assumes no responsibility for the Venue's core activity; its service is limited to digital presence and to the capture/analytics of foot traffic.

L3.4 · No unlawful activity

The Venue expressly declares that its activity does not include or promote procuring services (art. 187 of the Spanish Criminal Code), human trafficking, or the sexual exploitation of third parties. Breach of this declaration entitles Radar Nocturno to terminate the contract with immediate effect and to report the facts to the competent authorities.

L3.5 · Claiming the venue's listing

Signing up as a Venue requires prior validation of the claim of the listing in the directory. The claim process is governed by the operating rules published in /panel and may require documentary verification (ownership, licence, authorization from the owner).

L4 · Nature of the service

C2.1 · Core service

Radar Nocturno offers:

  • Occupancy status map: a traffic-light indicator (quiet / lively / packed / event) reported directly by each participating venue, not calculated from user activity. Independently, the App offers “visits”: a geolocation-based confirmation of presence at the venue's door, visible according to the privacy level each user has chosen (Invisible, Friends or Public) and which expires without leaving a trace; it is a social feature and never feeds the occupancy indicator.
  • Venue directory: static information about adult leisure venues supplied by the venues themselves or gathered from public sources.
  • Social features: a mutually confirmed friends system, private messaging between friends, and profile visibility settings.
  • Subscriptions: access to additional features depending on the current plan (specific rules in the Terms that apply to each mode).

C2.2 · Informational nature

Occupancy status is indicative and may not accurately reflect actual occupancy. It depends on the venue voluntarily reporting and updating its status. Without a current report, the App will show the venue with no signal instead of assuming any level of occupancy. Radar Nocturno does not guarantee the accuracy, completeness or currency of this information.

C2.3 · Relationship with venues

Radar Nocturno does not operate the venues shown in its directory or on its map. Including a venue does not imply a commercial relationship, endorsement, or any guarantee about the venue's conditions, the practices carried out there, or the safety of attendees. The decision to attend any venue is the user's sole responsibility.

C2.4 · What Radar Nocturno is not

Radar Nocturno is a tool for information about foot traffic and socializing among adults. It does not provide, broker or advertise paid sexual services, and any procuring activity within the meaning of art. 187 of the Spanish Criminal Code and related legislation falls outside its purpose. Using the platform to offer, seek or broker paid sexual services, or to recruit people for the purposes of sexual exploitation or human trafficking, is prohibited use and is sanctioned under the Acceptable Use Policy, without prejudice to reporting it to the competent authorities where applicable.

L5 · Acceptable use

C3.1 · General commitments

Every user of Radar Nocturno commits to:

  • Using the App in accordance with applicable law, public morals, public order and the applicable Terms.
  • Not using the App for unlawful purposes, in particular: identifying or tracking other users without their consent; impersonating identities; confirming false visits or visits to venues where they are not physically present; sharing information obtained on the App outside its authorized context; or distributing unlawful content through private messaging.
  • Respecting the dignity and privacy of other users in the social interactions the App allows.
  • Not using the App to broker paid sexual services or to recruit victims of human trafficking.
  • Not using the App for harassment, threats, blackmail, sextortion, non-consensual distribution of intimate content, or any other criminal conduct against other users.
  • Safeguarding their account credentials and not sharing them with third parties.
  • Not carrying out reverse engineering, mass scraping, denial-of-service attacks, or exploitation of the App's vulnerabilities.

C3.2 · Moderation policy

The Acceptable Use Policy available at /legal/uso-aceptable applies, setting out grounds for reports, sanction levels and the right-of-reply procedure. This Policy forms an integral part of the Terms.

C3.3 · Right of admission reserved

Radar Nocturno reserves the right to suspend or permanently close accounts that breach these Terms, without needing to expressly justify the decision beyond the grounds set out in the Acceptable Use Policy, which also establishes the right-of-reply procedure.

Additional commitments of the Venue

In addition, the Venue commits to:

  • Not using aggregated foot-traffic data to individually identify Radar Nocturno users, nor cross-referencing it with the Venue's own personal knowledge for that purpose.
  • Not reproducing, distributing or commercializing the analytics provided by Radar Nocturno outside the Venue itself without written authorization.
  • Reporting occupancy status diligently and in good faith, avoiding deliberately false or outdated reports that could mislead Users.

L6 · Subscriptions and payments

L6.1 · Current plans

The prices shown include VAT; the invoice will break down the taxable base and the VAT at the applicable rate.

L6.2 · Founding Venue Program (discontinued)

The Founding Venue Program (10 slots, a 30-day free trial of the Plus plan and a 50% discount for 6 months) was discontinued in full on 13 August 2026. No new slots or coupons are being granted. As of the date it was discontinued, the program had not been granted to any Venue, so there are no prior conditions to preserve.

L6.3 · Payment processor

Stripe Payments Europe, Ltd. (Ireland). Radar Nocturno does not store card data. The Venue receives an invoice in line with applicable tax law.

L6.4 · Start of the service and first charge

There is no free trial. The first charge for the contracted plan takes place at the moment the Venue signs up for a paid plan.

L6.5 · Cancellation

The Venue may cancel its subscription at any time from /panel. Access to the paid features remains available until the end of the billed period. No refund applies for periods already under way.

L6.6 · Price changes

Prices may be updated with 30 days' notice sent by email. Existing subscriptions keep the price they signed up at until their next renewal.

L6.7 · Non-applicability of the right of withdrawal

B2B subscriptions are entered into between professionals acting within their economic activity. The consumer protection regime does not apply (the TR-LGDCU) and, in particular, no right of withdrawal applies under art. 102 of the TR-LGDCU. This non-applicability is without prejudice to the ordinary contractual and commercial remedies.

L6.8 · Invoicing

Stripe generates the invoice for each charge using the tax details provided by the Venue. The Venue is responsible for keeping its tax details up to date on the Stripe portal.

L7 · Intellectual property

C4.1 · Brand

The trade names, trademarks, domains, logos and other distinctive elements of Radar Nocturno are the property of the owner. The word mark “Radar Nocturno” is on file with the Spanish Patent and Trademark Office (OEPM). Its use by third parties is prohibited without the owner's express written authorization.

C4.2 · User content

The alias, bio, avatar, messages and other content the user uploads to the App remain their property. By uploading it, the user grants Radar Nocturno a non-exclusive, royalty-free, worldwide licence limited in time to the life of the account to display it on the App and to provide the service.

C4.3 · Software

The App's source code, architecture and documentation are the work of the owner and are protected by intellectual property legislation.

The Venue expressly authorizes Radar Nocturno to use its trade name, address, public details of the establishment and, where applicable, its logo, in presenting its listing in the App and in informational materials related to the platform. The Venue may revoke this authorization in writing; in that case, the public listing will be reduced to the minimum directory entry or removed, depending on the plan's conditions.

L8 · Limitation of B2B liability

L8.1 · Application of the general limitation

C5.1 · Service “as is”

The App is provided “as is” and “as available”. Radar Nocturno does not guarantee continuous availability, the absence of errors, or specific results from use.

C5.2 · Qualitative exclusions

Radar Nocturno is not responsible for:

  • The accuracy or currency of occupancy status, which depends on each venue's voluntary report.
  • The conditions, safety or practices that occur at the venues shown.
  • The content of private messages, except for its duty of moderation when a legitimate report exists.
  • Indirect damages, loss of profit, loss of data, loss of reputation, or any consequential damage.

C5.3 · Force majeure

Radar Nocturno will not be liable for failures resulting from force majeure, an act of God, failures by technology infrastructure providers, large-scale cyberattacks, or decisions by public authorities.

The monetary caps and how they interact with the consumer's mandatory rights are set out in the B2C Terms; the B2B caps are set out in the B2B Terms. The names of the data processors are listed in the Privacy Policy.

L8.2 · Monetary cap

Radar Nocturno's aggregate liability towards the Venue for any claim arising from these Terms will not exceed the amount paid by the Venue in the twelve (12) months prior to the claim.

L8.3 · Exclusion of indirect damages

Indirect damages, loss of profit, loss of business opportunity, loss of the Venue's image or reputation, and consequential damages are expressly excluded, to the extent permitted by applicable law.

L8.4 · Indemnity from the Venue

If an individual user brings claims against Radar Nocturno over events that occurred at the venue or over the Venue's misuse of the platform's features, the Venue will hold Radar Nocturno harmless to the extent those facts are attributable to the Venue.

L9 · Amendment of the Terms

Radar Nocturno may amend these Terms. Material changes will be communicated by email with at least 30 days' notice. Continuing to use the service after the changes take effect means acceptance of the amended version. If the user does not accept the change, they may cancel their account at no cost before it takes effect.

L10 · Termination of the contract

L10.1 · By the Venue

The Venue may terminate the contract at any time by cancelling its subscription from /panel. The venue's listing may remain in free mode (“On the Radar”) unless a full withdrawal is expressly requested.

L10.2 · By Radar Nocturno

Radar Nocturno may terminate the contract with immediate effect in the event of:

  • Material breach of these Terms, of the Acceptable Use Policy, or of the declarations in L3.3 and L3.4.
  • Non-payment of the subscription.
  • Well-founded indications of fraudulent use, impersonation or criminal activity by the Venue.
  • Discontinuation of the service making it unviable to continue.

No refund applies for amounts already paid where the cause is attributable to the Venue. In the event of discontinuation of the service attributable to Radar Nocturno, the proportional part of the period not enjoyed will be refunded.

L11 · Privacy and data protection

The processing of personal data is governed by the Privacy Policy, which forms an integral part of these Terms.

A Data Protection Impact Assessment (DPIA) has been carried out and documented under art. 35 GDPR, given that the processing involves art. 9 GDPR data (special category data), both inferred from the context of use and voluntarily declared by the user through the optional profile tags.

In addition, regarding the aggregated foot-traffic data that the Venue receives through the dashboard:

  • Radar Nocturno provides the Venue exclusively with aggregated and anonymized data that does not allow individual users to be identified. The Venue is not a recipient of personal data within the meaning of the GDPR, nor a data processor.
  • The Venue commits not to attempt the re-identification of specific users by cross-referencing the aggregated data with personal knowledge or internal records.
  • For the processing of the personal data of its own clientele, the Venue acts as an independent controller; Radar Nocturno assumes no responsibility for that processing.

L12 · Communications

Notices to Radar Nocturno must be sent to hola@radarnocturno.com. Notices to users will be sent by email to their registered address and/or through notices within the App.

Contractual communications with the Venue will be sent to the contact email registered at sign-up and, failing that, to hola@radarnocturno.com.

The Venue consents to receiving commercial communications from Radar Nocturno related to the service, and may opt out at any time by replying to the email itself or by writing to hola@radarnocturno.com.

L13 · Applicable law and jurisdiction

L13.1 · Applicable law

These Terms are governed by Spanish and European Union law.

The competent jurisdiction and, where applicable, the preservation of the consumer's forum are set out in the B2C and B2B Terms respectively.

L13.2 · Jurisdiction

These terms are governed by Spanish law. In the absence of a mandatory rule to the contrary, disputes will be submitted to the Courts and Tribunals that have jurisdiction under the applicable procedural law.

L14 · Partial invalidity

Should any clause be declared null or unenforceable, the remaining clauses will remain valid and in effect.
