How your account works.

These Terms govern Radar Nocturno's relationship with the people who sign up to use the app. If you manage a venue, the Terms for venues apply to you instead.

U1 · Identification of the provider

U2 · Purpose

These Terms govern access to and use of Radar Nocturno (“the App”) by individuals who sign up as Users to consume the service in its free or paid mode. Accepting these Terms is an essential condition for using the App.

U3 · Access and eligibility

U3.1 · Minimum age requirement

Access to the App is restricted exclusively to people aged 18 or over. The App contains references to adult leisure venues (liberal clubs, BDSM, swinger, sauna, adult LGBTQ+ scenes) and its use is inappropriate for minors.

By signing up, you declare on your own responsibility that you are 18 or over through an express statement of your date of birth. This statement has the standing of a self-declaration.

Falsely declaring your age results in:

  • Permanent closure of the account. Amounts already paid will be handled under the applicable legal restitution regime, without prejudice to Radar Nocturno's right to seek redress for the damage caused by the false declaration.
  • Radar Nocturno taking whatever measures current legislation requires or allows it to take in defense of the integrity of the service and of its users, including reporting to the competent authorities where applicable.
  • Retention of the cryptographic hash of the email for the tiered period set out in the Privacy Policy §4.2, for the sole purpose of preventing the account from being re-created. All other personal data of the minor, including any declared profile tags, is deleted immediately.

U3.2 · Nature of the declaration

The declaration of legal age is a self-declaration. The App, in its current version, does not verify legal age through documentation. Adding optional documentary verification as a “Verified User” badge is contemplated as a future evolution of the product, and its initial absence does not exempt the user from their self-declaration.

U3.3 · Legal capacity

The user must have full legal capacity and capacity to act to enter into the contract represented by these Terms.

U3.4 · One account per person

Each user may hold only one account. The App reserves the right to suspend or close any multiple accounts it detects.

U4 · Nature of the service

C2.1 · Core service

Radar Nocturno offers:

  • Occupancy status map: a traffic-light indicator (quiet / lively / packed / event) reported directly by each participating venue, not calculated from user activity. Independently, the App offers “visits”: a geolocation-based confirmation of presence at the venue's door, visible according to the privacy level each user has chosen (Invisible, Friends or Public) and which expires without leaving a trace; it is a social feature and never feeds the occupancy indicator.
  • Venue directory: static information about adult leisure venues supplied by the venues themselves or gathered from public sources.
  • Social features: a mutually confirmed friends system, private messaging between friends, and profile visibility settings.
  • Subscriptions: access to additional features depending on the current plan (specific rules in the Terms that apply to each mode).

C2.2 · Informational nature

Occupancy status is indicative and may not accurately reflect actual occupancy. It depends on the venue voluntarily reporting and updating its status. Without a current report, the App will show the venue with no signal instead of assuming any level of occupancy. Radar Nocturno does not guarantee the accuracy, completeness or currency of this information.

C2.3 · Relationship with venues

Radar Nocturno does not operate the venues shown in its directory or on its map. Including a venue does not imply a commercial relationship, endorsement, or any guarantee about the venue's conditions, the practices carried out there, or the safety of attendees. The decision to attend any venue is the user's sole responsibility.

C2.4 · What Radar Nocturno is not

Radar Nocturno is a tool for information about foot traffic and socializing among adults. It does not provide, broker or advertise paid sexual services, and any procuring activity within the meaning of art. 187 of the Spanish Criminal Code and related legislation falls outside its purpose. Using the platform to offer, seek or broker paid sexual services, or to recruit people for the purposes of sexual exploitation or human trafficking, is prohibited use and is sanctioned under the Acceptable Use Policy, without prejudice to reporting it to the competent authorities where applicable.

U5 · Acceptable use

C3.1 · General commitments

Every user of Radar Nocturno commits to:

  • Using the App in accordance with applicable law, public morals, public order and the applicable Terms.
  • Not using the App for unlawful purposes, in particular: identifying or tracking other users without their consent; impersonating identities; confirming false visits or visits to venues where they are not physically present; sharing information obtained on the App outside its authorized context; or distributing unlawful content through private messaging.
  • Respecting the dignity and privacy of other users in the social interactions the App allows.
  • Not using the App to broker paid sexual services or to recruit victims of human trafficking.
  • Not using the App for harassment, threats, blackmail, sextortion, non-consensual distribution of intimate content, or any other criminal conduct against other users.
  • Safeguarding their account credentials and not sharing them with third parties.
  • Not carrying out reverse engineering, mass scraping, denial-of-service attacks, or exploitation of the App's vulnerabilities.

C3.2 · Moderation policy

The Acceptable Use Policy available at /legal/uso-aceptable applies, setting out grounds for reports, sanction levels and the right-of-reply procedure. This Policy forms an integral part of the Terms.

C3.3 · Right of admission reserved

Radar Nocturno reserves the right to suspend or permanently close accounts that breach these Terms, without needing to expressly justify the decision beyond the grounds set out in the Acceptable Use Policy, which also establishes the right-of-reply procedure.

U6 · Subscriptions and payments

U6.1 · Current plans

U6.2 · Payment processor

Payments are handled through Stripe Payments Europe, Ltd. (Ireland). Radar Nocturno does not store card data.

U6.3 · Start of the service and first charge

There is no free trial. The first charge for the Premium plan takes place at the moment the subscription is confirmed, in line with the pre-contractual information shown on the /checkout/confirmar screen.

U6.4 · Cancellation

The user can cancel their subscription at any time from Settings → Manage subscription. Premium access remains available until the end of the paid period. No refund applies for periods already under way, except where the cause is attributable to Radar Nocturno or under the consumer's mandatory rights.

U6.5 · Price changes

Prices may be updated with 30 days' notice sent by email to active subscribers. Existing subscriptions keep the price they signed up at until their next renewal.

U6.6 · Pre-contractual information

Under art. 97 of Spain's TR-LGDCU, before the distance contract is entered into the user is given the essential information about who they are contracting with, the subject matter, price, duration and the right of withdrawal. This information is presented prominently on the /checkout/confirmar page before payment.

U6.7 · Right of withdrawal

General rule. The consumer user in principle has a period of 14 calendar days to withdraw from the contract without needing to give a reason, under art. 102 of Spain's TR-LGDCU.

Withdrawal from continuous-performance digital services. Radar Nocturno is a continuous-performance digital service. If the User expressly requests that performance begin during the withdrawal period and withdraws within the 14 calendar days, they will pay the proportional part of the service already provided since the first charge (arts. 103.a and 108.3 of the TR-LGDCU). The right of withdrawal lapses once the service for the contracted period has been fully performed, provided the User has given express consent to the immediate start, acknowledged the loss of the right, and received confirmation of the contract under art. 98.7 of the TR-LGDCU. There is no free trial: the first charge takes place when the subscription is confirmed.

Form of the express consent. To extinguish the right of withdrawal under the terms of the previous paragraph, the user must:

  • State express consent to the immediate start of performance through a specific checkbox on the /checkout/confirmar screen, separate from acceptance of the Terms.
  • Acknowledge, on that same screen, that the right of withdrawal will lapse once the service for the contracted period has been fully performed, and that, if they withdraw beforehand, they will pay the proportional part of the service already provided.
  • Receive by email the confirmation of the contract on a durable medium, recording the consent and acknowledgment above.

Without these requirements, the right of withdrawal will remain in place under art. 102 of the TR-LGDCU.

To exercise withdrawal, the User may use the withdrawal form template in Annex B of the TR-LGDCU or any unambiguous statement addressed to hola@radarnocturno.com.

U6.8 · Invoicing

Stripe generates the invoice/receipt for each charge. The user can download it from the Stripe customer portal linked in the App.

U6.9 · Steps for entering into the contract (art. 27 LSSI-CE)

  • Steps to enter into the contract: account registration, plan selection, review of the pre-contractual information and consents on the /checkout/confirmar screen, and payment through the Stripe gateway.
  • Filing of the electronic document: Radar Nocturno files the electronic document in which the contract is formalized through the consent events, which retain the full text shown and its version. The document can be accessed on request to hola@radarnocturno.com.
  • Means to correct errors: before confirming, the user can review and change their selection on the confirmation screen itself, or leave it at no cost.
  • Language: the contract may be entered into in Spanish, English or French, at the User's choice among the languages available at the time of contracting. The Spanish version is the authentic version for interpretation purposes. However, under art. 80.2 of Spain's TR-LGDCU, in the event of discrepancy between versions, the wording most favourable to the consumer shall prevail. Radar Nocturno archives the version actually shown to the User together with the consent record.

U7 · Intellectual property

C4.1 · Brand

The trade names, trademarks, domains, logos and other distinctive elements of Radar Nocturno are the property of the owner. The word mark “Radar Nocturno” is on file with the Spanish Patent and Trademark Office (OEPM). Its use by third parties is prohibited without the owner's express written authorization.

C4.2 · User content

The alias, bio, avatar, messages and other content the user uploads to the App remain their property. By uploading it, the user grants Radar Nocturno a non-exclusive, royalty-free, worldwide licence limited in time to the life of the account to display it on the App and to provide the service.

C4.3 · Software

The App's source code, architecture and documentation are the work of the owner and are protected by intellectual property legislation.

U8 · Limitation of liability towards the consumer

U8.1 · Application of the general limitation

The common limitation clauses apply: service provided “as is”, qualitative exclusions and force majeure (see C5 below).

C5.1 · Service “as is”

The App is provided “as is” and “as available”. Radar Nocturno does not guarantee continuous availability, the absence of errors, or specific results from use.

C5.2 · Qualitative exclusions

Radar Nocturno is not responsible for:

  • The accuracy or currency of occupancy status, which depends on each venue's voluntary report.
  • The conditions, safety or practices that occur at the venues shown.
  • The content of private messages, except for its duty of moderation when a legitimate report exists.
  • Indirect damages, loss of profit, loss of data, loss of reputation, or any consequential damage.

C5.3 · Force majeure

Radar Nocturno will not be liable for failures resulting from force majeure, an act of God, failures by technology infrastructure providers, large-scale cyberattacks, or decisions by public authorities.

The monetary caps and how they interact with the consumer's mandatory rights are set out in the B2C Terms; the B2B caps are set out in the B2B Terms. The names of the data processors are listed in the Privacy Policy.

U8.2 · Monetary cap

To the maximum extent permitted by consumer protection law, and without prejudice to the consumer's mandatory rights under the TR-LGDCU and related legislation, Radar Nocturno's aggregate liability towards the User for any claim arising from these Terms will not exceed the amount paid by the User in the twelve (12) months prior to the claim.

U8.3 · Mandatory rights

Nothing in these Terms limits or excludes Radar Nocturno's liability for willful misconduct, gross negligence, damage to physical or psychological integrity, liability for defective products, or any other liability whose limitation is prohibited under consumer protection law.

U9 · Amendment of the Terms

Radar Nocturno may amend these Terms. Material changes will be communicated by email with at least 30 days' notice. Continuing to use the service after the changes take effect means acceptance of the amended version. If the user does not accept the change, they may cancel their account at no cost before it takes effect.

U10 · Termination of the contract

U10.1 · By the User

The user may terminate the contract at any time by deleting their account from Settings → Delete my account, or by requesting it by email to hola@radarnocturno.com. Deletion is final and involves anonymization under the GDPR (not physical erasure), except for legal retention obligations.

U10.2 · By Radar Nocturno

Radar Nocturno may terminate the contract with immediate effect in the event of:

  • Material breach of these Terms or of the Acceptable Use Policy.
  • Well-founded indications of fraudulent use, impersonation or criminal activity.
  • Discontinuation of the service making it unviable to continue.

In all cases the consumer will be refunded the proportional part of the period not enjoyed, unless the cause of termination is attributable to the User themself.

U11 · Privacy and data protection

The processing of personal data is governed by the Privacy Policy, which forms an integral part of these Terms.

A Data Protection Impact Assessment (DPIA) has been carried out and documented under art. 35 GDPR, given that the processing involves art. 9 GDPR data (special category data), both inferred from the context of use and voluntarily declared by the user through the optional profile tags.

U12 · Communications

Notices to Radar Nocturno must be sent to hola@radarnocturno.com. Notices to users will be sent by email to their registered address and/or through notices within the App.

U13 · Applicable law and jurisdiction

U13.1 · Applicable law

These Terms are governed by Spanish and European Union law.

The competent jurisdiction and, where applicable, the preservation of the consumer's forum are set out in the B2C and B2B Terms respectively.

U13.2 · Consumer's forum

For any dispute between Radar Nocturno and a User who has the status of a consumer, the court corresponding to the consumer's domicile will have jurisdiction, under art. 90.2 of the TR-LGDCU. Any clause contrary to the consumer's forum is null and void.

U13.3 · Alternative dispute resolution

The consumer may turn to the accredited consumer alternative dispute resolution entities under Law 7/2017, of 2 November. The list of accredited entities is published by Spain's Ministry of Consumer Affairs. Radar Nocturno will state in each case whether it is a member of, or bound to take part in, a specific entity.

U14 · Partial invalidity

Should any clause be declared null or unenforceable, the remaining clauses will remain valid and in effect.
